Moving across state line

I am in the first stages of getting a divorce. Now my husband live in a different state from me. I want to move to get a new start for me and my children. Can I move across state line during a divorce?

That depends upon the state where the divorce was started.

Your best bet, if you haven't filed yet and/or your husband hasn't been served yet is to ask a local attorney about whether you can move first, wait the required time, then file in the new place.

You can't do it to get around the law, but if NEITHER one of you live in the old state, and there's no ulterior motive, you can probably do it.

Definitely get a local attorney to pass on this, but it's something to consider. The court is unlikely to make both of you come back to a state where neither of you live, just to get a divorce.
