Parental rights while in prison

My ex-husband was convicted and sentenced to twelve years in federal prison for interstate transportation of child pornography in 2007. Since then I have re-married and children, ages 9 and 7, have accepted and love their step-father. Do to nature of the charges and limited contact is there any way I can revoke my ex-husbands parental rights in order for my new husband to adopt my kids? My ex-husband continuously harrasses them about visiting him in prison and he keeps using his status as a parent in order to get to them and me. What are my options?

Re: Parental rights while in prison

File a petition to terminate his parental rights and to adopt.

Even if he is maintaining contact with the children, he is unlikely to be paying child support, which is itself a basis for terminating parental rights under Tennessee law after four consecutive months of non-payment.
