Legal Question in Family Law in Wyoming

Upholding visitation orders in child custody case

My ex-husband got full custody of our 2 children several years ago. He resides with them in Texas, I reside in New Hampshire, the custody was awarded in Wyoming. He is refusing my court ordered visitation for the Summer. My son reported abuse to his school counselor, DFS followed up with a home visit, no action followed. I do believe there is abuse, from reports from my son. How do I exercise my visitation rights? To fight for custody, which state do I seek representation in? Do I have to take him to court for my visitation, and if so, where?

Re: Upholding visitation orders in child custody case

At this point in time, at least from the situation as you outline it, you will need to return to the State of Wyoming to ask that your ex-husband be held in contempt. At that time you may also wish to ask for change in custody, if you have anything other than your child's word to substantiate abuse.

As none of you reside currently in Wyoming, your husband could move to have the custody case transferred to Texas, then you would litigate the custody issues there. However, the issues of contempt of court should still be heard in Wyoming.

Best wishes.
