Legal Question in Family Law in Bangladesh
Salam
I am an university student. My mother died one and four months ago. I have a younger sister aged seven years old.
My problem is:
My father married a girl of my age just 10 days ago. We all live in a single room since my father can't afford a room more. Since they are husband and wife, it is normal that they engage in sexual activities. But when I do not stay at home, they keep doing so before the eyes of my sister. My little sister who was unaware of this facts now is questioning me why father does so and so with aunty. To avoid this situation, I think it is better for us to live separate from my father and I can afford our living.
My question is:
Can I claim the custody of my sister in a legal way? And will the court give me permission to keep my sister separate from my father?
Please think yourself once at my place and suggest me the best possible solution. Thank you

Your problem sounds exceptional. It is good to think about the well-being of your sister. But you are not allowed to do anything that you want because your father is alive and he is the natural guardian of your sister. He is primarily responsible for look after your sister. Question arises whether court will allow you to take your sister away from your father. I do not think the court will do that. Because there are millions of families that live in one room house. Their poverty does not take away father's right to maintain his daughter. If you file a case, the court at best may warn your father to do his personal jobs separately. You may get custody if your father denies to maintain your sister. Let me ask you one question, if you have ability, why don't you help your father renting a two-room house? I think solutionis there.
