Legal Question in Civil Litigation in India

Hi sir,

During 1982-83 government alloted house which is 10'x10' built and 20'x10' open space under one of the government scheme, those are don't have any land or house. My father takes the house in the name of grandmother. After grandmother died the house is shifted to my father name around 22 years ago. Now my Father's brother are asking the share of this land.

He had his own house and my grand mother regularly opts the government pensions (my grandfather is in military).

Upto my father lives he idnot ask any share but my father died 5 years back and now i want to renew the house to RCC and he enters the picture with claiming that share.

The grampanchayat Gharphala & Water bill is in the the name of my Father. My questions are as:-

Still I need to give his share in land?

Can I claim on his property for share as he used the grandmother pension?

I don't have any proof that he bought property from grandmother pension but his salary is around 16k from last 4 years but his property around 15-20 lac.

My father is worked in powerloom & Mother is farm worker upto last 10 years. From last ten years once i become the engineer My father brother are created relations with us and now he claiming the share.

What I can do.

Your answer is very useful to us because we are in deep trouble.

Let him file the case. You have lots of facts to counter his suit. Suit itself will take years to decide. Be in possession always.
