Legal Question in Employment Law in India

Hi All,

I joined in a company in India on Aug 2014. When I joined they gave me a offer letter without any details about notice period . Now I sent my resignation email they called me and said you have to serve 3 Months notice period. They are saying now as they will send employment confirmation letter with notice period details . They are saying that if you want experience and relieving letter serve the notice period of 3 months otherwise you can go out but we won't provide you any certificates.

Can you please help us what to do in this case ?

Dear Sir / Madam,

If the notice period is not mentioned in your Offer / Appointment Letter, it is implied that you will have to serve 7 days notice if you are on probation or 30 days if you are a confirmed employee in the Company. You should convey your decision to the Company accordingly. As far as the service certificate is concerned, you have ample evidence like Appointment Letter and salary slips to show any prospective employer that you have actually worked in the Company.
