Legal Question in Employment Law in India

Am serverd notice period and now i would like to take back it but my ceo not accepting it ,just 10 days back am served .and they are telling that new person selected for that position so it is not possible to take back my resignation.

can i take legal action against them? advice me.

Dear Sir / Madam,

Taking any employee back in the Company after he / she has resigned is entirely at the sole discretion of the Company. In your case, the Company has a perfectly valid ground to reject your reinstatement post resignation. Your legal action against the Company will not sustain in the Court, and hence is not advisable nor recommended.
