Legal Question in Family Law in Alabama

Owner ship of a van

I have a 2005 Dodge Grand Caravan that my husband went to the bank to help me to get. My credit is not good so he was suppose to be helping me. The van is in his name, but the monthly payment is deducted from my own personal checking account and I pay for the insurance which is also in his name, but for a discount and I also pay for the tag which is in the name thats the van is in. Who does this van belongs to legal? He has it parked in the back yard at the gate blocked with his cars in which I have no keys too. I am in the process of filing a report with the local police in the city that we live in. He works for the police department in the next city which is 7 miles from where we live, so some of his police buddies could be providing him with information cause he's always on the phone talking with them. What can I do? We are having some problems but I don't foresee divorce in the forecast right now, case I will definitely have to do my home work since he's so well like in his police department in the city. We are in the same county so if I do file for a divorce.....it will play out where he works. Please help me as soon as you can.

Re: Owner ship of a van

It could be considered marital property although it is in his name. But since you are not filing for divorce, then that would not be an action you are seeking relief under. On the other hand, you could file a suit in equity. But, your only relief is in a court of law as the title does have his name on it and as of now, it is lawfully his. It looks as if you may have to file for a separation or divorce and in such suit seek to have possession of the van.
