Legal Question in Immigration Law in Arkansas

Ok i was wondering what process to go to get my husband a visa. Im a us citizen. We have been together for 6 yrs and married for 3 months and have a one year old together. He came here seven years ago crossing illegally without a visa. Do i petition with the i130? How long Would he have to be in his country for before he could come back and if we have children is there any way to make the process faster? Also if i petition can i go to his country for part of the time to see him while petitioning?

Yes, the proper immigration process starts from a US citizen wife filing the I-130 Alien relative petition for her foreign husband. However, since he is not eligible for adjustment of status, he will need to go to his home country and apply for a visa and extreme hardship waiver.

The rest of your questions are very case-specific, and should be addressed to a lawyer in private and off of the public forum.
