Legal Question in Business Law in California

Where to Set Up?

I going to become a consultant after working years in an industry. I am a resident of CA but will be living in two different places overseas for at least 6 months of the year. Where should I form a company to get worldwide legal protection?

Re: Where to Set Up?

1. Legally there's no such thing as a "company." There are sole proprietorships, partnerships, and corporations.

2. What is it you want "worldwide legal protection" from? Usually people set up corporations or similar entities to protect their personal assets from the entity's creditors. There are a number of so-called "asset protection" strategies people use to attempt to shield their assets from creditors and/or tax authorities, but many of these schemes are illegal or won't work.

And who told you that you could get such a thing?? If you think you can get any 'world wide legal protection' from legal liability and risk, you are sadly underinformed. Insurance helps. Proper business formation and operation helps.

Forming a corporation is frequently done to shield your personal assets from suit for business debts and liabilities. An an American citizen, you could incorporate your business here and pay your business and personal taxes on income as required. You could also incorporate the business in some overseas tax haven and report your income and also pay your taxes here as required. Check to make sure that you won't also owe taxes in the countries where you work or form the corporation [likely].
