Legal Question in Technology Law in California

Copyright infringment?

I want to start an online company in which we would charge customers to download manuals for thousands of products i.e. Dell Laptop, Sony Digital Cameras, Casio watches, Fisher Price toys. Is it illegal to charge money to download these manuals?

Re: Copyright infringment?

There may be SOME way to set up and operate a business that does this without violating the copyright (and probably trademark) rights of the manual publishers, but it is not immediately apparent to me.

My advice is, that if this business looks very profitable to you, and you have adequate capital, then retain an intellectual-property attorney to analyze the specific of your business plan with copyrigtt and trademark law and give you a situation-specific written opinion.

If you can't afford or don't want such an opinion, or if the opinion is unfavorable, I'd forget this business idea rather than run what looks like a very high risk.

Re: Copyright infringment?

Aside from the obvious copyright problems, anybody with a brain can get most manuals for most late-model products by googling for them. But maybe the manufacturers don't supply outdated manuals, and maybe you can get permission -- which is what you would have to do.
