Posting a video of a minor on YouTube

A video of my minor child has been posted on YouTube. What are my rights regarding having this video removed?

You certainly can request that the video be removed from the web site. Whether Google will comply with the request depends upon several factors, such as:

1. who owns the copyright in the video

2. whether there was permission to flm your child

3. the content of the video (running the gamut from child pornography (always removed) to newsworthy items (almost never removed)

4. the extent of your child's involvement (i.e., was she the star, or just a face in the crowd?)

Google has purchased YouTube, and it is subject to California law, which provides for a right of publicity. You might have rights that would be more clear if an attorney understood your particular circumstances.
