Contract6ors Lien Rights

I was wondering if you can tell me if a contractor who never filed a 20 pre-lien and who also walked away and did not finish the job, are they entitled to file a lien against my property for o/s invoices he claims we owe him?

The requirement to file a 20-day preliminary notice does not apply to a prime contractor who is in direct contract with the owner.
