Credit Card Debt

If your parents have credit card debt and they pass away before paying it off are the children legally responsible for paying it off ?

Unless the children made some of the purchases or were consigners on the account, then they will have no personal responsibility for the charges. However, the the laws of probate and estate planning might require creidtors to be paid from the assets of the parents estate before distributions can be made in accordance with their will or living trust. You should consult a local probate/estate planning attorney for more information.
