Legal Question in Credit and Debt Law in California

how do i file an answer and motion for discovery in the state of california. I am being sued by HSBC for a debt that is not mine. I was consistently harassed by a "law firm" until they filed a summons against me.

You can fill out the standard answer form from the court's web site and at the same time as you serve the plaintiff serve them with interrogatories and requests for production. Check the Nolo Press books on how this is done. You can also go to a law library and look at California Forms for the formate for discovery and Weil and Brown's Civil Procedure Before Trial. You probably also want to file a cross-complaint against them; if there is a provision in their credit card terms and conditions that they are entitled to attorney fees then you migh talsobe able to collect for any attorney expenses you have. If you are very sure that you can show you do not owe the debt, you might be able to get an attorney to represent you if they believe they can get fees from HSBC [but normally cases get dismissed without either side getting their costs back].
