Legal Question in Credit and Debt Law in California

I subcribed ATT dsl internet service in august. But I was never able to connect online. I call their tech support couple times biut they can not get it working they said because my modem is not what they use. I talked to customer service manager and sak to cancel. but i still recieve bill for $40 from them. I call again and talk to rep he said it is taken care of. but later i recieved letter from collection! What can I do now.?

Am I supposed to pay for the service I never receive and now they make my credit back becuase of their bad product! Can I sue them in small claim court to remove my bad credit? What should I do? Please advise. Thanks Duke

Send their accounts payable department a certified return receipt letter (keep a copy) disputing that you owe anything, and explaining why. Also explain that the service rep was supposed to credit your account, but didn't. If that doesn't work, you can contact the state's public utilities commission to file a complaint.
