I won an award in Arbitration. How do I get it enforced?

I recently won an arbitration award (in Los Angeles). How do I get the award enforced? What court do I go to and what filing do I make with that court to make the arbitration ruling enforceable?

The arbitration award has to be confirmed by the court. As a judgment, assets can be attached or garnished to collect the judgment. Should you have any other questions, please call me.

You file in a Superior Court what is known as a Petition to Confirm Arbitration Award. The filing fee is the same as a regular lawsuit, and there is a motion fee as well. It must also be served on the respondent. Total costs should not exceed $500.

If this was a binding arbitration, then you would a Petition to Confirm Arbitration Award in the local superior court. The proper branch court is usually determined by the address of the person who lost the arbitration. You must get a hearing date from the court and have the petition and notice of hearing personally served on the opposing party. It is not that complicated to do.

You need to file a case in the superior court of the county in which the defendant is located, and get a judgment based upon the arbitration award.
