Legal Question in Criminal Law in California

Drug Paraphenelia

Hi, I'm in California. Recently my brother, his wife and my sister were on their way to the theater in hte rental he was given by the dealership (his car was being worked on) when they were pulled over for speeding, he allowed the officer to search the vehicle and the officer found a glass pipe under the driver seat. The officer began questioning who it belonged to and since no one knew he said he was going to arrest everyone so my sister immediately took the blame thinking they might take my brothers 4 yr. old son away. They ended up only getting a ticket for poss. of paraph. but none of them use or have ever used drugs. Will the ticket affect my sister down the road? What can she do? Or should she do? Thank you.

Well, she needs to get a lawyer and fight the charge. It was really poor judgment to have consented to a search or to have spoken one word to the police, and it was exceptionally poor judgment to have confessed. Your brother may yet lose his child as a result. Make sure Sis brings a lawyer to court with her on her first court date.

'Ticket"? She is charged with a crime, to which she confessed. If convicted, she has a criminal drug record 'forever'. Not too good a deal for having been 'helpful'. Get an attorney.
