Your boyfriend needs to file papers in court, called a parentage action to establish paternity of the child, and a custody visitation arrangement. He should do it immediately prior to the child being born, so that you can start on the visitation schedule right away, before the other parent has a chance to leave without a court order. The court order would prevent the other parent from leaving the area, without permission from the court.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
