divorce and properties

I am going through divorce and we

have properties together as husband

and wife as joint tenants. Should we

change them as single man and

woman as joint tenants?? what is

best for both??

Without a full review of your situation a recommendation cannot be given. There is a significant difference between joint tenancy and tenants in common. With joint tenancy if one of the joint tenants dies the surviving tenant or tenants become the owners. The interests of the joint tenants cannot be transferred by will. Tenants in common have the right transfer their interest in the property by will. With this information you should be in a better position to make a decision.
