Legal Question in Family Law in California

at issue memorandum

I was served with divorce papers in Aug 05,(I left family home, and asked him to start papers) and moved across the street from my home of 17 yrs. My soon to be ex-husband and my 18 yr son still reside there, I , with our 15 yr old daughter am trying to move from here, on our own. My question is, it seems as though the completion of my divorce is stalled, and at this point, I need to know what should be happening to reach the end? He has an attorney, I have only legal advice (payed for certain forms to be sent etc) and have relied on internet and self help libraries in order to comply as ordered. Our division of property has yet to be done, either by my removal of items, or even the opportunity to pack whats mine etc. After 17 yrs of marriage, we have much to consider ie: photos, important papers regarding children, 401k,insurance, and I believe I am also intitled to some portion of our vehicles, 1 being a 57 Cadillac that my grandmother was original owner of and, because of my relationship w/ex (was just boyfriend 20 yrs ago when she sold it to him for $500, hoping it would remain in family. A newerChevy truck a 69 Camaro and a speed boat that we bought a year before divorce, who decides how to divide? will this finish divorce?

You and your husband must agree on much of the division of community personal property, once a determination of the nature of the property is. Do you really want to do this yourself? Besides protecting your legal rights an attorney takes the brunts of what may be emotional confrontations in negotiations. There is also the difficult drafting of a marital settlement agreement, and, if pension is an issue a Qualified Domestic Relations Order is needed.Call me directly at 16192223504.

You have substantial assets, rights, concerns and obligations on which you are relying on your own internet and library research to give you the answers. You need to talk to an attorney so that you will know your rights and obligations as well as get the final dissolution completed. Good Luck, Pat McCrary
