Is there any way for me to make sure that my son does not go to his father if I die?

Only if you are able for some reason to terminate his parental rights before you die. If there are sound reasons under child dependency law for him not to go to his father if you die, and if someone steps up and applies to be his guardian, the court may well place him with a guardian rather than the father. There is nothing you can do while alive that will assure that will happen, however, unless the father's parental rights are terminated.
