Legal Question in Family Law in California

Mexico Vacation

I have primary custody of my 12 year old boy. We are going to Cabo San Lucas for a 4 day vacation. It doesn't state anywhere in our court agreement that I need his mothers permission to travel out of the country. Is this a standard formality or can I take him without her permission? She's giving me a hard time about him flying in an airplane not about Mexico. I know I can travel with him within the states on a plane without permission, can I out of country?

Re: Mexico Vacation

Get her to agree that you can take him on the vacation. Normally the court will the transporting parent to use any reasonable mode of transportation. If you are planning to fly a commerical airline you should have no problem. Flying in a private aircraft is more problematic. If she will not agree to flying to and from the vacation then go to court and get a court order and request that she pay your attorney fee.
