Legal Question in Family Law in California

Rights of the Father

My son and his girlfriend have been living together for 5 years. They have two children together a girl age 4 and a boy age 2. The girlfriend is threatening to leave and take the children. What recourse does my son have to prevent her taking the children away? What can he do?

Re: Rights of the Father

Fathers have alot of rights, unfortunately, unlike mothers, if the parents are not married the fathers need a court to establish their rights. Your son should get an attorney immediately because there are things he can do if she is threatening to move away with the child. He can stop her from moving far away. If you or your son would like to talk to me regarding his rights, please feel free to give me a call, I would be happy to talk to you about the situation.
