Legal Question in Civil Litigation in California

Since I will not be available, what is the procedure and timeline for me to request the Superior Court to postpone the date for the trial de novo that the defendant has asked? The hearing is set for April 18, 2013. Thank you.

There is no timeline. You should ask opposing counsel for an extension. If counsel agrees, then you should submit a stipulation to the court asking for the extension. The court may also have an informal policy for extensions, if the parties agree to the change of date -- but it will require an agreement.

If counsel does not agree, then you must file an ex parte application for a continuance, explaining why you cannot appear. Granting the continuance is at the complete discretion of the court.

I would be prepared to change my plans for April 18, if I were you. Or, you hire a lawyer to appear for you for this hearing.
