Employee or contractor?

My company hired me as a ''contract'' employee, that status to go on for 90 days until company determined A) my performance, and B)if the company really needs a person in the position permanently. That was 8 months ago. Company pays me directly, withholds income taxes, SSI, etc. but will not pay benefits. I want to be fully employed, benefits included.

Is the company's action (or lack thereof) legal? Can they treat me as a full-time employee without extending benefits?

It sounds like you legally are an employee and not a contractor but they are not required to give you or anyone else benefits.
