Legal Question in Landlord & Tenant Law in California

Co-sign Agreement

I co-signed a rental agreement for my brother and his girlfriend. They have been served with a 3 day notice for non- payment of rent. Am I liable for past rent and late payments ?

Re: Co-sign Agreement

Absolutely!

A cosigner guarantees payment, and is only necessary, when the other signer, or signers, have bad credit and/or poor payment history.

Next time you sign a contract, read it carefully.

In addition, if your brother and girlfriend do not pay, it will appear on your credit reports as an eviction, which is about equally as bad as a bankruptcy, if and when you need additional credit.
