Legal Question in Landlord & Tenant Law in California

Receiving my full security deposit

I lived in an apartment from February 2008 until July 2008. I had signed a six month lease in February. In May, I got a new landlord and was told I had to resign for an additional six months. Within May and June, my car and my boyfriend's car got broken into, and my dog was stolen and recovered. I had no choice but to decide to move. I had to break the lease unless I found someone to take over. Luckily, I found someone to move in. I had to patch the holes in the walls while at the same time find paint to match what the paint was when I moved in. The paint did not match exactly once I was finished. The landlord said he was going to charge me $400 for the paint. The new tenant was already moved in. The paint is not expected to be done until October. Is it legal for him to charge me $400 for paint when someone is taking over my lease?

Re: Receiving my full security deposit

Yes!

I am glad you recovered your dog.

If you, or your guests, put holes in the wall, you are responsible for the reasonable cost of repair ($400 for paint does not sound reasonable).
