Legal Question in Sexual Harassment in California

yes, my boyfriend shane is 22. when he was 19 he has sex with a 17 year old girl. The mom tried to press a case against for statuatory rape. There was no evidence so the case went cold basically and now all of a sudden the cops called him asking him to come in for questioning. Could he go to prision after all this time?

If he volunteers to visit the police station or to answer their questions without a lawyer present, he is too dumb to qualify as boyfriend material.

He should immediately exercise his 5th Amendment rights to SHUT UP. He should not speak with anyone about the case except his attorney.
