First of all, doesn't your company have a lawyer (other than the LawGuru BBS) to go to on employment law matters? If not, and I am local to your area, I would be pleased to consult with you in grater detail.

My advice: If you are an employer asking for anonymous advice on which to base a decision that could get you and the company sued, you should re-think this process.

You need to consult with experienced employment counsel, do a proper investigation, and render a decision based upon all the facts of the investigation and the attorney's opinion.

Feel free to contact me if you decide to do this right. Employment law has been a speciality for over 20 years.
