Legal Question in Wills and Trusts in California

My wife of 60 years passed away in Sept 05. Our assets together total just about $100,000. Yesterday I received a check (from my wife's deceased aunt's estate) for $50,000 made out to ''the estate of (my wife's name)...''

My bank will not accept a depost of this check until I open an ''estate'' account. They said I needed an EIN number which I got from the IRS. Now they say I need a notarized form establishing an ''estate''. But they are unable to tell me from whom I get this form.

How does one go about establishing an ''estate'' and who must it be established with? IRS? SSA? State of CA? County of LA?

I presume there is not a will. You may have to file in probate court. Apart from property held in joint tenacy, did she own separate property under $ 20K? Call me directly at 16192223504.
