Legal Question in Wills and Trusts in California

my father preceded my mother in death, but my mother never filed the surviving spouse form. I am the executor of her will, do I have to file the surviving spouse form? Probate is in the state of CA

I assume you mean the affidavit of death of joint tenant to clear your dad's name off joint tenancy real estate. If I am correct then yes you do need to do that. There are other options but hard to know based on the facts given. Feel free to call me Thursday to discuss. -John
