life insurance beneficiary

Couple is married for 40 + years. Husband dies and current wife discovers he never changed beneficiaries from first marriage.

Can second wife collect? Current wife received retiremnet benefits. Policy is for just under 5k$.

Life insurance is payable to the named beneficiary. I suppose she could sue trying to argue it was a mistake but the attorney fees would eat up much of the policy and probably would not succeed.
