Legal Question in Wills and Trusts in California

help

I am on SSI + SDI. When my mother passes away I will be getting an inheritance. Heard I could lose my SDI + SSI. Is this true? If so, what options do I have to protect myself from losing ALL the incomes? Please help me understand my rights.

Thank you,

Betsy

Re: help

you mother needs to consult with a qualified estate planning attorney to consider establishing a special needs trust for you, rather than a direct gift of assets to you at her death.

Re: help

There is certainly a possibility of this happening. There is also a possibility that they will come to you for reimbursement of money already paid out to you. It will depend on a number of factors too long to list in this forum. Also, I will need additional details of your situation.

Your (most probable) best bet is to have the inheretence placed into an irrevocable spend-thrift trust. This way, it is out of your control but you will be provided what is necessary by the trustee.

This is a complicated matter and should be discussed in detail with an estate planning attorney. Our firm would be happy to assist you and discuss this matter with you further.

If you would like to discuss this matter further in a more private forum, please feel free to contact me directly at the email address provided by LawGuru or through our firms website located at PasadenaEstatePlanning.com
