Legal Question in Workers Comp in California

First Aid/Workman's Compensation

I have been going back and forth between my former employer and the hospital in which I received care for a work injury for the past 3 years. On my last correspondence, I sent the itemized bills to the corporate office of the company I worked for and they said they would pay them once they got it. I thought this was finally taken care of; however, I noticed on my credit report I just obtained, that the hospital sent the overdue bills to a collection agency and is now on my credit. I am now fed up with my former employer in regards to this. I have done everything they wanted me to do in order to get this taken care of. What is my next recourse in handling this and getting the medical bills bills paid and the creditor off the credit report? Please help.

Usually it is the carrier that reimburses those bills. Either way you need to have a hearing at the WCAB. Contact me directly.

Unless your employer is self-insured [gerally only really big companies are], they have a WC carrier that handles all the aspects of claims. Send the bills to them ; mention that a penalty would apply if timely payment has not been made and that you want them to clean up your credit record. Also cc the hospital and tel them they should hae done thta and should have know not to turn the matter over to a collecction agency so the should write the credit agencies to get the bad reference off your statement. The comp. carrier should have to provide copies of yor credit reports for the next 3 months so that you can be sure it has been removed and that it is not put back on. If none of that works, give me an e-mail and I will write you a free nasty letter.
