Legal Question in Workers Comp in California

Help...I've been cut loose!

I have been on Workers Comp for over a year, had surgery on my wrist, but had other issues from the injury that were never addressed...now they tell me that my benefits are complete. I still have pain in the areas tbat have been ignored and don't know what to do. Do I have any legal alternatives?

The insurance company will not willingly pay you money. If the doctor's reports are complete, you need to file a document called a "Declaration of Readiness" -- go to your local Workers Compensation Appeals Board for the document, and the matter will be set for a hearing. If the doctor's reports are not complete, you need to request a QME (your own doctor) or agree to an AME (agreed doctor) to evaluate you and provide a report -- then you have to set the matter for a hearing at the court (basically, a settlement conference where you negotiate with the insurance company the amount of money to be paid to you) by filing the Declaration of REadiness.
