Legal Question in Personal Injury in Canada

table saw injury

i was working at a cabinet making business and lost the tip of my left index finger on the table saw. worker's compensation made the company change the guard on the blade. The new guard is 3 times as big as the one they had before. I was wondering if I have any kind of a case against this company for them having the wrong guard on the saw?

In British Columbia you are not permitted to sue when the injury occurred on the job; you must claim compensation from WordSafe BC.
