Underage drinking DUI

My 20-year-old stepdaughter lives in Texas with her dad and I. She visited her brother in Colorado and while driving one night, he threw a beer can out the window of the vehicle. They were pulled over by a cop, and since she was driving, (and had had a couple of beers, but not drunk)she was held liable. She refused the breath test, but agreed to a roadside test. She was sent to detox overnight, but said they did not take away her license. She will have a trial, I'm assuming. How does this affect her Texas license, her Texas insurance? Will she still need to get an SR-22? Can she still plead innocent? Will it follow her Texas? What can we expect? They didn't advise her what the blood test results were.

I am a Colorado DUI attorney. I can help her with her case here. The blood results will not be available for a couple weeks. If they come up over .08, she will be mailed a Notice of Revocation. She has 7 days to respond or she will lose her privilege to drive in Colorado for one year (and until she complies with reinstatement requirements). This may affect her privilege to drive in Texas if they find out.

I have several DUI attorney friends in Texas and can help with that portion of the case, but I do not have the answer off the top of my head.

I would fight the Notice of Revocation and the criminal case. Both can be won. I would not wait to hire an attorney, I would do it now.

The effects WILL follow her to Texas. The level will depend entirely on the outcome of the Colorado case. Mr. Savela has given you good advice,and you should retain a Colorado attorney right away.
