Legal Question in Employment Law in Colorado

On the Job Drug Testing

Is it legal for a peer to go to a supervisor and tell him that they think you are stoned and then demand you be drug tested?

The company has a no tolerence policy, but I am curious as to who can make a decision about whether or not you are stoned.

Re: On the Job Drug Testing

Drug testing can be done by your employer and it is usually part of the employer policies. Check the policies for exactly how drug testing can be carried out.

As to whether a co-worker can suspect someone of using drugs and report it to manager, YES. How the manager proceeds with this information is up to the manager and the company policies. The co-worker could not force you to subject to a drug test if s/he is not a superior or does not have that authority. You can always refuse to do a drug test, but the company policies may dictate that you will get fired.
