Subpoena for Senior Citizen

My Mother who is 86 has been sent a subpoena for a car accident she was in two years ago. She was the driver. The other driver is suing her and her car insurance for 'pain & suffering', when she apparently was not hurt when the wreck occurred. My Mother has very little memory retention and cannot recall events. She is very upset about this and will not be able to relate any details about this accident if called to the stand. What should we do to keep her from having to go through this. Her health is not good and this entire ordeal may be detrimental to her failing health. My Mother no longer is able to drive.

Tell your insurance company to settle the case. There are few cases where the plaintiff will not come to a reasonable settlement based on his/her medical bills and other losses. Often times, the insurance company is fighting over a very small amount of money.

Request to know the offer the plaintiff made, the offer the insurance company made, the amount of medical bills, and approximately how much the insurance company will spend on lawyers for a trial.

You will have a better idea of what this is all about.

Finally, you may wish to speak with the Plaintiff's attorney. They may give you different and more truthful answers than the insurance company lawyers.
