Legal Question in Family Law in Connecticut

My ex and I have been divorced for almost a year. In our Separation Agreement it states that my ex is responsible for 80% of our children's medical/dental expenses after insurance. Two of our children have waited two years to have braces on their teeth. I have started the procedure, and now my ex has called the orthodontists office and has stated that he will not be financially responsible for any work performed. He claims he cannot afford it, which is not true, as we just sold and split the proceeds from the marital residence. Can he flat out deny financial responsibility? Can he force me to wait to have the work done?

Its hard to give a precise and detailed answer without seeing your agreement. However, your husband is most likely responsible for a large portion of this expense. Based upon the facts as you state them, it appears he could be in contempt of court. You should file a post-judgment motion for contempt and request the court to order him to pay his portion. The children should not have to wait.
