Legal Question in Immigration Law in Connecticut

How do I file for my Spouse & Child?

I am a 55 year old Permenent resident (almost 3 yeas). I have a Husband & 17 year old child back in my home country. What are the steps that I need to do in order to get them here & how long does it take. Thank you very much for any help.

Hi,

It will depend on how you got your residency on whether you can file anything for your son and husband before you become a US Citizen.

Normally a petition of a resident for her spouse might take a few years to process depending on what country you are coming from and they type of application that you are filing.

Feel free to email me at [email protected] if you need assistance with the process.

The simple answer would be over 4 years (if you are not from Mexico) and you remain a permanent resident. However, if/when you apply for citizenship all of that changes. You should be able to get both your spouse and child here in approximately one year after obtaining citizenship (maybe more or less depending on your particular circumstances). One concern I would keep in mind is that children "age-out" once they hit 21 so we would want to try and avoid that possibility. Give me a call in the office and I will be more than happy to discuss your case with you.
