Am I being discriminated against?

I've been at present job for 1 1/2 years. Job performance is measured by productivity(how much you are paid versus how much work you do ''mechanic hours''). This figure determines your value to the co.(raises, promotions etc.)My immediate sprvr. has been ''redirecting'' my mech. hours to himself and also voiding work orders that involve warranty work. Doing these things makes his productivity as Svc Mgr. look great and showing that he does mech work also provides for a year end bonus, mean while my productivity goes way down. On last year's review he wrote that I was a good worker but needed to be more productive. He doesn't know that I know what he has been doing. He also has thwarted all attempts at me becoming a service writer, a position that would put me next to him at the service desk. Several other employees have been ''promoted from within'' while I remain in the shop. What do I do?

You ask if you are being discriminated against. It does appear you are being treated badly. Whether any anti-discrimination laws are being violated would depend WHY your boss is treating your in such a way. If the treatment you receive is based on your age, race, religion, national origin or disability, there may be a violation of the law. If your being treated badly for some other personal reason, for example you do not share his love of the Tampa Bay Bucs, then he may just be a jerk who is not violating the law. I suggest you discuss this in more detail with an employment attorney.
