Legal Question in Disability Law in Florida

Threat of losing job

I had seizures in May 2006 and since that time my employer has continually questioned my ability to do my job and has on at least two ocassions referred to me being different since my seizures. She has also repeatedly referred to my ''critical thinking'' skills. She has now given me a ''heads up'' that I should look for another job because I am not working out. Can she do this?

Re: Threat of losing job

Under the Americans with Disabilities Act ("ADA") an employer can terminate your employment if you are unable to perform the essential functions of your position. However, if there is some sort of reasonable accommodation that will allow you to perform the essential functions of your position, then your employer has an obligation to supply that to you.
