Human resources at my employment made a

mistake by handing my time sheet in late. I did not

get my paycheck and have been without money for

almost a month now. They refuse to cut me a

check. I would like to kow my rights and who can I

talk to about getting paid?

Your employer is probably violating both federal and state statutes. I suggest that you file a complaint with both the U.S. Dept. of Labor and the FL Dept. of Labor. They both are probably on the web.

There is an extremely short statute of limitations for this type of claim under FL law. Consult an attorney if this matter does not resolve within the next few months. Most attorneys, including the undersigned, welcome this type of case. Eventhough the amount of the claim is usually small, if the employee prevails, the law generally provides that attorney fees will be paid by the employer.

You should schedule a formal consultation with a lawyer. A good means of obtaining an attorney referral is by contacting your State's bar association or your local county bar association. They probably have a web site and charge a nominal fee for the referral. Most attorneys either provide a free initial consultation, or charge a nominal fee.
