evict someone with a baby

i want to know if i can evict my tenant for not paying the rent? she's no because she has a baby

You can evict someone if they are not paying the rent. Having a baby to support is not an excuse for not paying your rent. If you want to work something out with her because she is poor, is not working, and just had the baby, then you can. But you are under no legal obligation to allow her to stay rent free. And it is not a civil rights violation to evict her for not paying rent if only excuse is that she has a baby.
