Legal Question in Consumer Law in Florida

bed bugs

We stayed at KOA camping cabins, Florida for two nights. The first night the kids were up all nite because the cabin was infested with bedbugs, crawling all over. We set off three bombs at our own expense and had to stay out of the cabin for five hours total. It didnt kill the bugs so we switched out of that cabin having to move everything out for 6 people and spent two + hours washing our bedding. I wasnt offered any refund except to move rooms. I am hoping we didnt bring any of the pests home with us. My question is am I entitled to a full refund of our stay ?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such nformation, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Forgetting the law, you should be able to receive a refund and perhaps more by reporting this to the national office of KOA. Each campground is required to maintain certain standards and I am sure that this does not meet the requirements. KOA will certainly want to keep this incident out of the limelight that a lawsuit would bring.

Second, you should be able to dispute the charge if you paid with a major credit card. You should report your problems immediately when you receive your statement or you can call know and get a complaint form in order to contest the charge. Generally, a disputed charge will be removed and it will be up to the campground to convince your credit card company that they deserve to get paid.

If you do not obtain results on your own, retain an attorney who might be able to not only get the charges reversed but also some damages (payment of money) for you due to what transpired.

You would need to check the KOA refund policy. It certainly sounds like they should refund your money because you weren't able to use the cabin.
