Gift Certificate Expiration

Is it legal for a business to put an expiration date on a gift certificate paid for in full in Florida? Do I have an recourse if they say it is expired? They claim that it is only good for one year and expired on 12/31/04.

RESPONSE: I know of no cases on point, but if you were to file suit your claim would be for unjust enrichment. "The elements of a cause of action for unjust enrichment are: (1) plaintiff has conferred a benefit on the defendant, who has knowledge thereof; (2) defendant voluntarily accepts and retains the benefit conferred; and (3) the circumstances are such that it would be inequitable for the defendant to retain the benefit without paying the value thereof to the plaintiff." Hillman Constr. Corp. v. Wainer, 636 So.2d 576, 577 (Fla. 4th DCA 1994). Therefore, unless the Defendant could prove that it is equitable for retaining the benefit of the value paid for the gift certificate you may have a chance to get your money back.
