Legal Question in Credit and Debt Law in Florida

credit card debt and medicaid

My mother will be going on medicaid in a rehab/nurisng home in Florida. I am the POA and in NY. Her mail is forwarded to me. She has two credit card debts, one $220, the other over $3000. There is only about $800 in her bank after the medicaid payments will be made monthly. Do I default on the charge bills? or pay up the small ones? What can they legally do since she is bed ridden?

Re: credit card debt and medicaid

Since she is on social security and medicaide, there is no way that the credit card companies can collect on the debt. The $800.00 per month seems a little high after payment of the nursing home bills. I do believe the situation will be settled after the rehab/nursing home takes its share.

The $800.00 can provide her with some pleasures while she is in a nursing hom.

If she has no other assets they really can't do anything.
