Legal Question in Credit and Debt Law in Florida

Hi, I am a UK citizen and resident in the UK. I bought a villa in Florida in 2005 but due to circumstances beyond my control the villa was foreclosed this year. I have just received a letter stating that I owe $180,000. Can this dept be collected in the UK, in other words am I in danger of loosing my house/ possesions in the UK?

If they obtained a deficiency judgment against you in Fla, they may seek to enforce it in the UK. Talk with your attorney about UK law but I would assume they have a foreign judgment procedure. Good luck.

You really need to speak to a solicitor in the UK regarding the enforceability in the UK of a judgment entered in a United States court. It may make a difference if the judgment in the US was entered by default (because you did not respond to the lawsuit), or if you defended the lawsuit in the US and lost the case in a trial.

There are a number of treaties between nations regarding the enforceability of foreign judgments. I believe that the US has not signed most of those treaties, so US judgments are often not enforceable in other nations, and vice versa.
